Representatives Conyers and Smith:

I come with heavy heart and a deep sense of foreboding for the well being of our country. But it is my duty as a military veteran and citizen to bring you the attached Articles of Impeachment against Barrack Obama, our sitting president.

All efforts to have my elected Representatives take this initiative have failed. My requests have been ignored. They have failed to do their duty according to the oath they swore when they assumed office.

I find no precedent for my actions in reviewing the impeachment process in law history, nor do I find any stipulations in the procedures of Congress that preclude my actions. Impeachment is not a process of either civil or criminal law but rather it is yet another of the wonders of the Constitution of the United States that allows for checks and balances to control the government. In the case of impeachment it is the method that Congress uses to control an out of control Executive. In the case of my submission, I am simply making the charges instead of the congressman that I elected.

My charges, which are attached as Articles I through IV, have to do with subversion of the Constitution and abuse of power which will lead to Impeachment in the House and conviction in the Senate for, “. . . Crimes and Misdemeanors . . .” according to Article II, Section 4.of the Constitution.

Your immediate processing of this action is imperative for national security reasons. Many military personal have joined class action lawsuits and are refusing deployment sighting the questionable qualifications of their commander. Businesses are failing from un-constitutional government interference. There is much unrest in the general population from the strange and unconstitutional behavior of our sitting president. Your timely actions will help return our country to stability.

Impeachment of Barack Obama

Article I:

In his conduct while President of the United States, Barack Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has willfully corrupted and manipulated the legislative process of the United States in that:

(1) he has appointed approximately 32 “czars”, to date, in direct violation of constitutional provisions that, “No Title of Nobility shall be granted . . .”according to Article I, Section 9, pp 8 of the Constitution of the United States;

(2) appointment and use of these persons by the Executive: “ . . . threatens our Constitutional system of checks and balances”, according to Senator Byrd. This is so, in direct violation of constitutional provisions because all of those 12 powers of congress, excluding the militia, that are specifically delineated in the Constitution according to Article I, Section 8, pp 1-8, have been usurped by the “czars”. The executive, “ . . . recommend . . . (to the congress for) . . . their Consideration such Measures as he shall judge necessary and expedient, . . . he shall take Care that the Laws be faithfully executed, . . . “, as enumerated in Article II, Section 3, pp1. This means, quite simply, that the president administers and executes the laws generated by the legislative powers vested in Congress but does not make the laws and;

(3) during his nine-month term, to date, he has nationalized various industries, to wit General Motors and others and taken government control of and assumed direction of various financial institutions. These activities are not enumerated as one of those 12 responsibilities of Congress (to delegate?) or authorized by the executive powers described in the Constitution. These maneuvers were in direct violation of constitutional provisions affecting the referenced sections, in provisions, in the Bill of Rights, and the intentions of the Founders as the constitution was written.

In doing this, Barack Obama has undermined the integrity of his office, has brought disrepute on the Presidency, has betrayed his trust as President, and has acted in a manner subversive of the Constitution, to the manifest injury of the people of the United States.

Wherefore, Barack Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States.


Impeachment of Barack Obama

Article II:

In his conduct while President of the United States, Barack Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has willfully corrupted and manipulated the legislative process of the United States, in that:

(1) during his nine months in office he has usurped the powers of congress by attempting to oversee the 2010 census, first by attempting to place his aide de camp in an oversight position with the Department of Commerce, U. S. Bureau of the Census and then by assigning his community activist organization in enumerating positions in the Census Bureau which is un-constitutional according to Article I, Section 2, pp 3 whereby the census shall be conducted, “. . . in such Manner as they (Congress) shall by Law direct.”. Congress has directed that the Census Bureau, not the Executive, conduct the Census for very obvious reasons, namely that the census results control voting districts and;

(2) not re-instating the citizenship question in the census is also un-constitutional according to the constitutional references of paragraph four and supreme court decision of paragraph five, below. During his attempt at control of the census he was also guilty of attempting to enumerate illegal immigrants.

The constitution in Article I. Section 2. para 3 on apportionment states: ". . . .Number of free Persons, . . . " but this was superseded by Amendment XIV. Section 2. " . . . , counting the number of whole persons . . . ." and "But when the right to vote at any election . . . ." "is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, . . . representation therein; shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens . . . .". The age and gender provisions of this Article were later superseded, of course.

In the 1964 case of Wesberry v. Sanders, the Supreme Court said, “The House of Representatives, the [Constitutional] Convention agreed, was to represent the people as individuals and on a basis of complete equality for each voter.” It ruled that Georgia had violated the equal-vote principle because House districts within the state did not contain roughly the same number of voting citizens. Justice Hugo Black wrote in his majority opinion that “one man’s vote in a congressional election is to be worth as much as another’s.” The same principle is being violated now on a national basis because of our faulty census.

By attempting to maneuver around the Constitution and control the census, Barack Obama has undermined the integrity of his office, has brought disrepute on the Presidency, has betrayed his trust as President, and has acted in a manner subversive of the Constitution of the United States, to the manifest injury of the people of the United States.

Wherefore, Barack Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States


Impeachment of Barack Obama

Article III:

In his conduct while President of the United States, Barack Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has willfully corrupted and manipulated the legislative process of the United States, in that:

(1) he has issued monies of the United States to a foreign country according to an August 18, 2009 article in the Wall Street Journal, “The Obama administration is financing oil exploration off Brazil”. “The U.S. Export-Import bank tells us it has issued a preliminary commitment letter to Petrobas (Brazil’s nationalized oil company) in the amount of $2 billion . . .”;

(2) and according to an August 14, 2009 article in Bloomberg, Petrobas is George Soros’ largest hedge fund holding at $811M. Soros is known to be a heavy Obama financial backer with speculation that Soros actually controls the Democratic Party;

(3) so loaning Soros’ major holding $2B is quid pro quo, “straight up”, as it were, and Chicago Politics at its finest, all rolled into one and;

(4) in addition to being a tremendous breach of public trust, this is also un-constitutional, since control of fiscal matters is enumerated to Congress in the Constitution according to the enumerated powers found in Section I, Article 8 and only execution of congressional mandates is enumerated to the executive branch according to Section II, Article 3. Here is where we find the very simple delineation of powers; the Legislative makes the Laws and the Executive carries them out. And Congress did not delegate the authority to loan money to foreign nations to the Executive.

In doing this, Barack Obama has undermined the integrity of his office, has brought disrepute on the Presidency, has betrayed his trust as President, and has acted in a manner subversive of the Constitution of the United State, to the manifest injury of the people of the United States.

Wherefore, Barack Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States.


Impeachment of Barack Obama

Article IV:

In his conduct while President of the United States, Barack Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has willfully corrupted and manipulated the executive and legislative process of the United States for his personal gain and exoneration, in that:

(1) he sits as president without having been properly certified as meeting, or offering certifiable proof of meeting the requirements for president as enumerated in the Constitution according to Article II, Section 1, pp5;

(2) proof rests thereof in the fact that the Democratic National Committee (DNC) certified according to the requirements of the state of Hawaii that he did in fact meet the Constitutional requirements for the office of President but did not certify to this fact in the 48 contiguous states or the state of Alaska. There are no provisions in the Constitution for certification of any elected officer for public office in the United States (why would there be?) but convention and protocol amongst the political parties has done so over the years. The Republican Party (RNC) has always done so and until recently the DNC has also done so. But only in this election cycle did the DNC certify in Hawaii and omit certification from all other states and;

(3) therefore, by omission of certification and absence of disclosure of certifiable evidence there is no question of the lack of qualifications of the sitting president.

In doing this, Barack Obama has undermined the integrity of his office, has brought disrepute on the Presidency and the United States, has betrayed his trust as President, and has acted in a manner subversive of the rule of law and justice and the Constitution, to the manifest injury of the people of the United States.

Wherefore, Barack Obama aka Barry Soetoro, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States.
