According to an internal U.S. Citizenship and Immigration Services memo going the rounds of Capitol Hill and obtained by National Review, the agency is considering ways in which it could enact “meaningful immigration reform absent legislative action” — that is, without the
consent of the American people through a vote in Congress.

“This memorandum offers administrative relief options to . . . reduce the threat of removal for certain individuals present in the United States without authorization,” it reads.

Also: “In the absence of Comprehensive Immigration Reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations, exercising discretion with regard to parole-in-place, deferred action and the
issuance of Notices to Appear (NTA), and adopting significant process improvements.”

In recent weeks, Sen. Chuck Grassley and others in Congress have been pressing the administration to disavow rumors that a de facto amnesty is in the works, including in a letter to Department of Homeland Security
head Janet Napolitano. “Since the senators first wrote to the president
more than a month ago, we have not been reassured that the plans are
just rumors, and we have every reason to believe that the memo is
legitimate,” a Grassley spokesman tells NR. (NR contacted DHS, but a spokesman did not have a comment on the record.)

Many of the memo’s proposals are technical and fine-grained; for
example, it suggests clarifying the immigration laws for “unaccompanied
minors, and for victims of human trafficking, domestic violence, and
other criminal activities.” It also proposes extending the “grace
period” H-1B visa holders have between the expiration of their visa and
the date they’re expected to leave the country.

With other ideas, however, USCIS is aiming big. Perhaps the most egregious suggestion is to “Increase the Use of Deferred Action.” “Deferred action,” as the memo defines it, “is an exercise of
prosecutorial discretion not to pursue removal from the U.S. of a
particular individual for a specific period of time.” For example, after
Hurricane Katrina, the government decided not to remove illegal
immigrants who’d been affected by the disaster.

The memo claims that there are no limits to USCIS’s ability to use deferred action, but warns that using this power indiscriminately would be “controversial, not to mention expensive.” The memo suggests using
deferred action to exempt “particular groups” from removal — such as the
illegal-immigrant high-school graduates who would fall under the DREAM
Act (a measure that has been shot down repeatedly in Congress). The memo
claims that the DREAM Act would cover “an estimated 50,000” individuals, though as many as 65,000 illegal immigrants graduate high school every year in the U.S.

In the immediate wake of the court decision blocking the Arizona immigration law yesterday, the memo is sure to create controversy — and the sense that the administration is bent on preserving and extending
the nations de facto amnesty.

UPDATE: USCIS has released a statement on the memo:


Internal draft memos do not and should not be equated with official action or policy of the Department. We will not comment on notional,
pre-decisional memos. As a matter of good government, U.S. Citizenship and Immigration Services
(USCIS) will discuss just about every issue that comes within the
purview of the immigration system. We continue to maintain that
comprehensive bipartisan legislation, coupled with smart, effective
enforcement, is the only solution to our nation’s immigration
challenges. 

Internal memoranda help us do the thinking that leads to important changes; some of them are adopted and others are rejected. Our goal is to implement policies wisely and well to strengthen all aspects of our
mission. The choices we have made so far have strengthened both the
enforcement and services sides of USCIS — nobody should mistake
deliberation and exchange of ideas for final decisions. To be clear,
DHS will not grant deferred action or humanitarian parole to the
nation’s entire illegal immigrant population.

Such an idea is treacherous. The "government" (regime) would be so eager to "legalize" the illegal invaders that little attention would be paid to verifying their identification. Hence, not only would useless outcasts from 3rd-world countries become voting liberal citizens but, along with them, the middle-eastern terrorists who have taken advantage of the porous border could become citizens, also. It would be so much easier for terrorists to perform theirAllah-blessed tasks if they carried the IDs of U. S. citizens. How long has it been since the last time that traitors against this country were executed? TOO, TOO LONG!

Unfortunately, I truly believe that the current administration hates America so much, and the populace that supports him is either part of the "ruling class" or an immature person who thinks it is the cool thing to do to be liberal (and that is the extent of their knowledge about politics).

Our "takeover" has been long in the process and insidious. Every movie, go back to some of your old favorites, has a political innuendo that slurs conservatism and makes liberalism the hero! And who influences our kids? That's right...Hollywood and the television industry and our liberal schools.

We have a big, big job in front of us to retain any kind of freedom and to clean up the corruption in our government. Just complaining to each other will never get it done.

This type of governing has been in the process for a long time. It is not just the Democrats that are guilty of setting up a government where they can act at their own discretion to bring about whatever they decide to bring about. It is not just with amnesty for illegals, it is with every branch of government. George Bush approved the FDA Amendments Act of 2007 which gave the FDA practical control of our health care without the passage of the Obamacare legislation. We are, more and more, with each passing year, becoming a nation where the people are subjects to the ruling class!

The Founding Father's were not morons! They knew if the representatives of the people found out they could line their own pockets at the expense of the people we would be in trouble. Who are our representatives in Congress? The biggest majority are Lawyers & actually represent less than 0.01 % of the population in general. Representatives of the People were supposed to be representative of the total population not 0.01 or less. The people in Congress, Pelosi, Reid, Boxer, Schumer & a slew of others have no idea how the average American Citizen lives. $50,000 to them is like 0.05 to the average taxpaying Citizen. Until we elect people who actually represent the average American Citizen, there will be no common sense laws enacted nor will they be laws to enhance the Rights either given or guaranteed to American Citizens under our Constitution & it's Amendments. Right now elections are actually bought by the people with the most money. That is one of the reasons Obama became President. He had almost unlimited funds to buy air time, hire recruiters & yes, pay for votes. The only way to stop this madness is limit all candidates finances to an even Dollar amount. All can spend up to one Million dollars to be Government financed & everyone will be on a level playing field. There will be no paying back "favors" for monetary support from the Rich or corrupt. Candidates can then compete on their principles & or Ideology & won't be able to buy votes (like Obama is trying to do with the Illegals). Our Representatives need to be composed of & from the general public. Business Owners, Farmers, Dr.'s, assembly line workers & other citizens making up the Majority of US Citizens. A lawyer making $200 to $500 an hour hasn't got a clue how someone making $8 to $30 thousand lives day to day. There is no way that they can know. A $200 monthly power to them is chump change while the average citizen may find that amount hard to pay & still buy food, gasoline (to get to work), car insurance & other every day expenses. This is why they are not frugal with our money & seem to think everyone makes $200 to $500 an hour, so lets use it. Congress was supposed to be a part time job & was never meant to be a lifetime Career & was to be convened to enact "NECESSARY" laws & not laws to benefit the few or privileged. Congress has not been following this example for the last 80 years or more. If this Country is to survive, we need to get people who are committed to the Constitution, Representation for the average working class Citizen, Protection of this Country from Invasion from any source & enactment of only necessary Laws to protect our freedoms.
We also need term limits to keep our Representatives honest & worthy of our trust. Lawyers need not apply, as you are over qualified.

Please to you all, I understand the strong feelings, believe me, I am near despair for my country, but you must not endanger yourselves or REsistNet or other conservative sites by talking violence. We must go through every legitimate means possible to save our nation. And we must pray! If you believe in prayer, then pray, pray for God to save our nation, remove those who want to destroy our Constitution and soverignty and raise up righteous people to serve in the State and Federal government. Pray!

AMEN!! I couldn't have said it any better. I get so enraged at everything that's going on and everyday it's one thing or another. I know we will prevail and God is right along side of us. To end, it's good we can vent although we need to be careful here, and no doubt anywhere on the Internet, and it wouldn't surprize me, the telephone/cells. I'm fortunate to be near one of my daughters who listens to me, but then I listen to her, also.

I warned of this months ago and was laughed at. Now it is coming down the pike and Arizona is the catalyst. Don't get me wrong. I support Arizona 100%. However, I wish they could have waited until after the November elections to pursue it. By forcing the government's hand at this point in time could conceivably backfire. Realistically, we cannot ship 12,000,000 illegals home. What we can do is cut off their incentive to stay. They come here looking for (1) work (2) healthcare (3) education (4) subsidies for housing, food and utilities and (5) SSI. Now we have a problem. With the exception of healthcare all other freebies could be cut off. Where does that leave them? On our streets, alleys, parks and in the shadows. Desperate people do desperate things. First and foremost I fault Mexico. What is wrong with that country that they cannot prosper? The Mexican people are not stupid nor lazy, but if they are hungry, they will fight to feed their families. I would like to hear from some of you who have non-violent, sensible solutions to the problem.

Iris, I agree that we need a non-violent, humanitarian solution to the proper. Even if one of us comes up with one, the "King" will do whatever he wants. I agree wholeheartedly that he only concerned about furthering his power by encouraging illegal immigration.

I have been pretty angry about the immigration issue. I live in Texas where there are sanctuary cities and nothing is being done. They have underground economies (Austin, for example) where illegals underbid others for contracts but they don't live by our laws or pay taxes.

Maybe amnesty for the ones already here is the only answer, IF we stop the influx of more of them. Amnesty conditions would require that they step forward and get a social security number, pay back taxes (even if it takes a lifetime to pay them off) and penalties, and fall under the same laws as the rest of us. I don't know how we are going to make them play on the same playing field the rest of us must compete on otherwise. And you are right, they are NEVER going to be rounded up and sent home.
