According to an internal U.S. Citizenship and Immigration Services memo going the rounds of Capitol Hill and obtained by National Review, the agency is considering ways in which it could enact “meaningful immigration reform absent legislative action” — that is, without the
consent of the American people through a vote in Congress.

“This memorandum offers administrative relief options to . . . reduce the threat of removal for certain individuals present in the United States without authorization,” it reads.

Also: “In the absence of Comprehensive Immigration Reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations, exercising discretion with regard to parole-in-place, deferred action and the
issuance of Notices to Appear (NTA), and adopting significant process improvements.”

In recent weeks, Sen. Chuck Grassley and others in Congress have been pressing the administration to disavow rumors that a de facto amnesty is in the works, including in a letter to Department of Homeland Security
head Janet Napolitano. “Since the senators first wrote to the president
more than a month ago, we have not been reassured that the plans are
just rumors, and we have every reason to believe that the memo is
legitimate,” a Grassley spokesman tells NR. (NR contacted DHS, but a spokesman did not have a comment on the record.)

Many of the memo’s proposals are technical and fine-grained; for
example, it suggests clarifying the immigration laws for “unaccompanied
minors, and for victims of human trafficking, domestic violence, and
other criminal activities.” It also proposes extending the “grace
period” H-1B visa holders have between the expiration of their visa and
the date they’re expected to leave the country.

With other ideas, however, USCIS is aiming big. Perhaps the most egregious suggestion is to “Increase the Use of Deferred Action.” “Deferred action,” as the memo defines it, “is an exercise of
prosecutorial discretion not to pursue removal from the U.S. of a
particular individual for a specific period of time.” For example, after
Hurricane Katrina, the government decided not to remove illegal
immigrants who’d been affected by the disaster.

The memo claims that there are no limits to USCIS’s ability to use deferred action, but warns that using this power indiscriminately would be “controversial, not to mention expensive.” The memo suggests using
deferred action to exempt “particular groups” from removal — such as the
illegal-immigrant high-school graduates who would fall under the DREAM
Act (a measure that has been shot down repeatedly in Congress). The memo
claims that the DREAM Act would cover “an estimated 50,000” individuals, though as many as 65,000 illegal immigrants graduate high school every year in the U.S.

In the immediate wake of the court decision blocking the Arizona immigration law yesterday, the memo is sure to create controversy — and the sense that the administration is bent on preserving and extending
the nations de facto amnesty.

UPDATE: USCIS has released a statement on the memo:


Internal draft memos do not and should not be equated with official action or policy of the Department. We will not comment on notional,
pre-decisional memos. As a matter of good government, U.S. Citizenship and Immigration Services
(USCIS) will discuss just about every issue that comes within the
purview of the immigration system. We continue to maintain that
comprehensive bipartisan legislation, coupled with smart, effective
enforcement, is the only solution to our nation’s immigration
challenges. 

Internal memoranda help us do the thinking that leads to important changes; some of them are adopted and others are rejected. Our goal is to implement policies wisely and well to strengthen all aspects of our
mission. The choices we have made so far have strengthened both the
enforcement and services sides of USCIS — nobody should mistake
deliberation and exchange of ideas for final decisions. To be clear,
DHS will not grant deferred action or humanitarian parole to the
nation’s entire illegal immigrant population.

I am tired of being governed by fiat. This is getting scarier and scarier-we have no representation whatsoever-then the "king" does whatever his will is.

Are they really pushing for a real revolution? Then they can impose martial law and muffle us totaly-the gestapo is coming to a community near you.

It isn't 1984 it is 2010 where an oligarchical collectivist society takes over the lives and the government of the USA, is a world of perpetual civil war, pervasive government surveillance, and incessant public mind control. The individual is always subordinated to the masses, and it is in part this philosophy which allows the Party to manipulate and control humanity.

When someone has been in the USA for years and have committed no crimes and has completed high school and are contributing to our society, we need to respect that they left their country for a reason, to escape a nation that is full of corruption and gives them no hope. Every one that is just being harsh about deportation are being unrealistic about the facts. The USA has allowed the Mexican immigrants to come into our society to benefit us. Now that it has become a problem, we just want to discard them with no regards. I have a real hard time with anyone calling themselves a Christian and agreeing to strict deportation. Do you not realize theses people will be left homeless and may even starve if sent back to Mexico. You are uprooting children from their homes and schools and neighborhoods that know no other life.

I agree with not handing out welfare check and giving free medical, but for those who have came here and lived for years and worked and stayed out of trouble they should be treated with respect and consideration. (They should not be able to vote until they have completed their citizenship requirements.)

We need to concentrate all our efforts on the Mexicans that are bringing in drugs and involved in sex trafficking and other crimes. Get them out of our Country and punish them harshly.

We need to cool it, no violence please.....you will be deeply sorry...they will just use Martial Law to stop it all, and then regroup because we all have shown our colors (even if it is just a few)! We must join forces, this must be organized. Tonite on Glen Beck's show is a start. Watch it if you can....Pray and Pray for guidance. This is not EASY STREET! But one slip and we are all gone! Keep on, keeping on, don't give up....There is a positive note: Arizona is not taking this lying down. And they have every right to insist in accountability under the Constitution. We are not being trampled on yet. We are being poked and prodded into negative action. Don't give the Devil what he wants.....Cool, calm, and collected and we are growing stronger every minute. Europe and Asia are watching. The Australians are praying. Please dear God, hear us!

Sorry, they broke the law...they need to be deported now. It's easy, just do it. They can get in line and do it right the next time.

Most do not want to be citizens anyway, but simply want what they can take from America. Why should we not enforce existing immigration laws? If we did, self-deportation would get rid of millions, the others might take a while longer, but it can be done..

Leaving them here and rewarding them for the crimes they have committed sounds like what the usurper is going to do and......as usual, he's totally wrong.

I am so tired of hearing about "the poor immigrants" and THEIR rights. They have the right to return to their country and apply to immigrate legally to come to OUR country. They do not have the right to invade our country and expect us to feed them, house them, educate them, and provide free medical care. We the people have a right to deny their entry especially if they have criminal records, illnesses, or will compete with our citizens for jobs or college education. Many of these unlawful entrants are criminals and commit heinous crimes once here.The president has no right to give a blanket amnesty that would violate our laws of governance. The people of Arizona should not have to pay 2.7 billion in taxes to care for these unlawful invaders. I agree that illegals must not be rewarded for breaking into our country.

Excuse me but that is what got us into this mess in the first place. Because they were brought here a a child does not make them a citizen and they are cutting in front of all those who are trying to do this the right way who also have children
and can't get here before the child is in college. This is an invasion of our country and they are taking jobs that we will do but can't get because they will work cheaper. Our highschool and and college students used to work in fast food places and restaurants, etc. on their summer vacations but those jobs are gone many to illegals. The Denver airport got in trouble a couple of years ago because they had dozens illegals working there, all using the same social security number
and don't try to tell anyone that a job at a major airport is not a job that an American citizen would not take.
My brother adopted a child from Europe and he had to fie for citizenship for the boy.
We are a country of laws and the minute they illegally step onto our soil they have broken the law. If they catch you in Mexico the first time you go to prison for 2 years, the second time it is 10 years and they dare protest our laws. Fine lets use there laws, much better.

I'm sorry Ms. Parmenter, but I have to differ with you. By your own words, it shows that illegal aliens have no interest in becoming American citizens. Many of them have been here for years, but have never bothered to apply for the amnesty that the current and previous administration offered. In fact, during the Clinton reign, about six "mini-amnesties" were offered and practically NONE of the illegal aliens took advantage of it. Illegal aliens aren't here because of any sense of allegiance to this country, they're here for the MONEY! Their allegiance will always be with their home countries.

Furthermore, if their home country is so "currupt", why is it that they don't take measures to fight the corruption? No, they come here because they know they can make money, while being supported in large measure, by American taxpayers, and send most of their earnings back to their home countries. They broke the law coming here and should be treated as such, common criminals. The U.S. government didn't allow them to come here to "benefit" us. They let them come here because, a. Republicans wanted to provide big business with lots of cheap labor; and, b. Democrats wanted a source of cheap votes. The only "benefit" that was derived was the billions of dollars sent out of the country to benefit the home countries of the illegal aliens.

Whoa! Stop the stage! First of all, I don't think there's a person here who has a problem with LEGAL immigrants (the only kind there is.) Where the problem arises is with ILLEGAL ALIENS, regardless of what country they come from. And, I don't care how long they've been here. Illegal is criminal. If they want that so called "better life" for their family, let them return to their home country and come back here legally. If you were illegal I'd want you deported, also. And, if I was illegal, I should expect no less than to be deported.

Take a look at any other country you want to... check their laws against "illegal aliens". No other country on earth would allow you to have ANY freedom or any benefits or anything else other than a small jail cell if you were an illegal in their country. Why should we welcome them all with open arms? They are coming here to dismantle the USA. If you don't believe that, watch the videos of their protests... proof way beyond a shadow of a doubt.

The only way ANY alien should be treated with any respect and consideration (which they show none of towards U.S. citizens) is if they come here legally, learn the language, denounce their former country, fly ONLY the U.S. flag, and make every effort to assimilate into our culture. That is the only acceptable course.

My dear, I am a high school teacher whose students are mostly illegal from Mexico. The number one reason they are here is for their parents to receive taxpayer benefits. The "I only want a better life" story has gone on for many decades without regard for conditions in Mexico. I only want a better life, we all want a better life. No one has the right to steal. That is exactly what entering illegally and taking American benefits is. Being a Christian does not mean being a sucker. That"s exactly what Mexico considers us. You should hear mynstudents laugh at us. "You white people (Americans) are so stupid. Of course we're going to come here. . .why not? We get everything free!" They feel entitled to take whatever they want from us, make no mistake about that. And the Left/Marxists use every guilt mechanism on the good hearted in the US to make you feel responsible for the illegals. Unfortunately, the parents of the illegal children are responsible for their plight. they knew what they were doing and must accept the consequences. And yes, they still speak Spanish, because the vast majority of people from Mexico refuse to assimilate in the US forcing us to adopt their culture instead.

I do totally agree with Mindy's statement. The Maxist in office are using the illegals to further their cause. Many Mexicans are aware of this and no longer support Obama because of that.. They realize they are being used and set-up.
